1. Introduction and Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of pigoid.com (the “Website”), your voluntary contributions to the Pigoid film project and your purchase and use of digital products offered through the Website.
The Website and the Pigoid brand are owned and operated by Cum Laude OÜ (“Pigoid”, “we”, “our”, or “us”).
By accessing the Website, making a voluntary contribution, purchasing a digital product or otherwise using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website, make a contribution or purchase our products.
If you act on behalf of a company or other organisation, you confirm that you have authority to bind that organisation to these Terms and to use the payment method provided.
2. Definitions
For the purposes of these Terms:
- Consumer means a natural person acting for purposes outside their trade, business, craft or profession.
- Contribution means a voluntary monetary payment made to support the production of the Pigoid film without entitlement to goods, services, rewards, ownership rights, profit participation or repayment.
- Contributor means a person or organisation that makes a Contribution.
- Digital Product means a PDF course or other digital content supplied electronically through the Website.
- Order means an order placed through the Website for a Digital Product.
- User means any person who accesses or uses the Website, makes a Contribution or purchases a Digital Product.
3. Eligibility to Use the Website
You must have the legal capacity to enter into a binding agreement in your country of residence to make a Contribution or purchase a Digital Product.
If you are under the age at which you can independently enter into a contract, you may use the Website, make a Contribution or purchase a Digital Product only with the involvement and consent of a parent or legal guardian.
You are responsible for ensuring that the information you provide is accurate, complete and current and that you are authorised to use the payment method provided.
4. Digital Products and Services
We offer PDF courses and may offer other Digital Products from time to time. The main characteristics, content, format, price, compatibility information and any specific usage requirements of a Digital Product are described on the relevant product or checkout page.
Digital Products are supplied electronically and no physical product will be shipped. Unless stated otherwise, access or a download link is provided immediately after successful payment.
You are responsible for ensuring that your device, software and internet connection are capable of accessing and using the purchased Digital Product.
We may make reasonable updates to a Digital Product to correct errors, improve security or maintain compatibility. Any changes will be made in accordance with applicable law and will not reduce your statutory rights.
5. Orders and Contract Formation
By placing an Order, you make an offer to purchase the selected Digital Product under these Terms.
A binding contract for a Digital Product is formed when your payment has been successfully processed and we provide an Order confirmation or make the Digital Product available to you, whichever occurs first.
We may refuse or cancel an Order before delivery where reasonably necessary, including in cases of suspected fraud, an obvious pricing or technical error, unavailability or a violation of these Terms. If we cancel a paid Order before delivery, we will refund the amount paid.
Please contact us promptly if you do not receive access to the Digital Product after successful payment.
6. Payments
Payments for Contributions and Digital Products are processed securely by Stripe. Stripe may collect and process payment, contact and transaction information in accordance with its own terms and privacy policy.
We do not receive or store your complete payment card details.
You confirm that you are authorised to use the payment method provided and that the payment information is accurate. A Contribution or Order is not complete until the payment has been successfully processed.
Payments may be displayed and processed in a currency different from the currency of your card or bank account. Your bank, card issuer or payment provider may apply currency conversion rates or fees for which we are not responsible.
7. Voluntary Contributions
Contributions support the development and production of the Pigoid film. The Contributor chooses the amount, subject to any minimum or maximum limits displayed on the payment page.
Contributions are voluntary and do not constitute the purchase of a product or service. A Contribution does not give the Contributor any goods, services, rewards, ownership rights, intellectual property rights, investment interest, share of profits, decision-making rights or right to repayment.
A Contribution does not create any guarantee or obligation that the film will be completed, released by a particular date, distributed through a particular platform, contain particular content or achieve any particular commercial, creative or other result. Creative, production, financing, release and distribution decisions remain solely with us and our authorised production partners.
We may use Contributions for costs reasonably connected with the development, production, post-production, promotion, administration, financing and distribution of the Pigoid film project. Contributions are made to Cum Laude OÜ and do not create a trust, escrow arrangement, partnership, joint venture or fiduciary relationship.
Except where required by applicable law or where we determine that a payment was duplicated, unauthorised, fraudulent or made in error, successfully processed Contributions are generally non-refundable. Any approved refund will normally be returned to the original payment method. Nothing in these Terms limits rights that cannot lawfully be excluded.
8. Optional Supporter Acknowledgements
When making a Contribution, you may be asked whether we may consider displaying your chosen name at the end of the film. This choice is optional and you may make a Contribution without requesting public acknowledgement.
Providing permission or a chosen name does not guarantee inclusion in the film. It is a voluntary acknowledgement and is not a good, service, reward or other benefit provided in exchange for the Contribution.
We retain reasonable editorial and production discretion over the film credits. We may omit a submitted name for production, technical, legal, safety or editorial reasons, including where a name is unlawful, misleading, offensive, infringes another person’s rights or is otherwise unsuitable for publication.
You confirm that you have the right to submit the chosen name and that its publication will not infringe another person’s rights or violate applicable law. A submitted company name, brand, logo, promotional message or similar commercial material will not be treated as advertising or sponsorship unless we have expressly agreed otherwise in a separate written agreement.
If a chosen name is included, it may be visible worldwide as part of the film’s end credits through screenings, distribution, streaming, broadcasts, recordings and other authorised releases of the film.
You may withdraw permission or request a correction by contacting info@pigoid.com. We will honour requests where reasonably possible before the film credits are finalised. After a version of the film has been completed, released or distributed, it may not be technically or practically possible to remove or change the name in copies that have already been produced or made available. Further information is provided in our Privacy Policy.
9. Prices and Taxes
For a Digital Product, the price payable is the price displayed at checkout when you place your Order. For a voluntary Contribution, the amount payable is the amount you enter or select and confirm before payment.
Prices for Digital Products will state whether applicable taxes are included. Any additional charges applied by us to an Order will be disclosed before you complete the purchase.
We may change Digital Product prices at any time, but a price change will not affect an Order that has already been accepted.
If a Digital Product price is clearly incorrect due to an obvious technical or human error, we may cancel the affected Order and refund any amount paid.
10. Right of Withdrawal and Refund Policy for Digital Products
Consumers in the European Union and European Economic Area generally have a statutory right to withdraw from a distance contract within 14 days without giving a reason. Special rules apply to digital content supplied without a tangible medium.
Before receiving immediate access to a Digital Product, you may be asked to:
- expressly consent to the supply of the Digital Product beginning before the end of the 14-day withdrawal period; and
- acknowledge that you lose your statutory right of withdrawal once supply of the Digital Product has begun.
Where you have provided that express consent and acknowledgement and the supply or download of the Digital Product has begun, you no longer have the statutory right to withdraw from the purchase merely because you changed your mind.
If you have not provided the legally required consent and acknowledgement, your statutory withdrawal rights remain available as required by applicable law.
Except where required by law, we do not provide refunds after the download or supply of a Digital Product has begun. This does not affect your statutory rights if the Digital Product is defective, unavailable, materially different from its description or otherwise does not conform to the contract.
If a Digital Product is defective or you cannot access it, please contact us at info@pigoid.com. We may first attempt to provide access, correct the issue or supply a conforming copy. Any repair, replacement, price reduction, termination or refund required by applicable consumer law will remain available.
Approved refunds will be issued using the original payment method unless otherwise agreed and will be processed within the period required by applicable law.
11. Licence and Intellectual Property
The Website, Digital Products, film materials, course content, text, graphics, illustrations, characters, designs, branding, logos and other materials are owned by or licensed to Cum Laude OÜ and are protected by copyright, trademark and other intellectual property laws.
When you purchase a Digital Product, you receive a limited, personal, non-exclusive, non-transferable and revocable licence to download and use it for your own private, non-commercial purposes, unless the product description expressly states otherwise.
You may not, without our prior written permission:
- copy, reproduce, republish, upload, post, transmit or distribute a Digital Product, except for a reasonable personal backup copy;
- share, sell, sublicense, rent, lend or otherwise make a Digital Product available to another person;
- modify, translate, adapt, create derivative works from or commercially exploit a Digital Product;
- remove copyright, trademark, ownership or other proprietary notices; or
- use a Digital Product to create or train a competing product, service, course, database or artificial intelligence system.
Purchasing a Digital Product or making a Contribution does not transfer any ownership or intellectual property rights to you.
12. Acceptable Use
You agree not to:
- use the Website or any Digital Product for unlawful, fraudulent or abusive purposes;
- attempt to gain unauthorised access to the Website, its systems, accounts or data;
- interfere with the security, availability or proper operation of the Website;
- introduce malware, harmful code, automated scraping tools or an unreasonable technical load;
- circumvent access controls, payment systems or technical protection measures;
- misrepresent your identity or payment authority; or
- use our content in a way that infringes our rights or the rights of another person.
13. User Content and Communications
The Website does not currently provide public user-posting features. If you send us feedback, enquiries, testimonials or other material, you confirm that you have the right to provide it and that it does not infringe another person’s rights or violate applicable law.
You retain ownership of material you submit. Where you expressly agree that we may publish a testimonial or similar material, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that material for the agreed purpose. You may withdraw permission for future use by contacting us, without affecting lawful use that occurred before withdrawal.
Supporter names submitted for possible inclusion in the film credits are governed by Section 8 of these Terms and our Privacy Policy.
14. Third-Party Services and Links
The Website may use or contain links to third-party services, including Stripe, analytics providers, video platforms and other external websites.
Third-party services are governed by their own terms and privacy policies. We do not control and are not responsible for the content, security, availability or practices of independent third-party websites or services, except to the extent responsibility cannot be excluded under applicable law.
The inclusion of a third-party link does not necessarily imply endorsement.
15. Privacy and Cookies
Our collection and use of personal data, including payment information and optional supporter names, are described in our Privacy Policy. The Website may use essential cookies and, with consent where required, analytics, functional or marketing cookies.
Cookie preferences can be managed through the cookie banner or settings made available on the Website. Where consent is required, non-essential cookies will not be activated before consent is provided.
16. Educational Information and Disclaimer
Our Digital Products are provided for general educational and informational purposes. Unless expressly stated otherwise, they do not constitute personalised legal, financial, medical, tax or other regulated professional advice.
Results depend on individual circumstances, decisions, effort and factors outside our control. We do not guarantee any particular personal, professional, financial or other outcome from using a Digital Product.
We take reasonable care to provide accurate and useful content, but information may become outdated and may not be suitable for every user. You are responsible for deciding whether the content is appropriate for your circumstances and for obtaining professional advice where necessary.
Nothing in these Terms excludes warranties, remedies or other rights that cannot lawfully be excluded or limited.
17. Availability of the Website
We may update, maintain, suspend or modify the Website where reasonably necessary. We do not guarantee that the Website will always be available without interruption or error.
Where you have purchased a Digital Product, temporary Website unavailability does not remove your statutory rights. We recommend downloading and securely storing your purchased PDF course after access is provided.
18. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for intentional misconduct, gross negligence, death or personal injury caused by negligence where applicable, fraud or mandatory consumer rights.
To the maximum extent permitted by applicable law, we are not liable for indirect or consequential loss, loss of profit, loss of business opportunity or loss resulting from a User’s failure to follow reasonable technical or security instructions.
Where you purchase a Digital Product as a Consumer, any limitation of liability applies only to the extent permitted by mandatory consumer law.
Where you purchase and use a Digital Product for business purposes, our total aggregate liability arising from the relevant Order will not exceed the amount you paid for that Digital Product, except where liability cannot legally be limited.
Nothing in these Terms creates liability merely because the Pigoid film is delayed, changed, not distributed through a particular platform or not completed, except to the extent liability cannot lawfully be excluded.
19. Indemnification
If you use the Website or a Digital Product for business purposes, you agree to compensate us for reasonable losses, liabilities and costs arising directly from your unlawful use, infringement of intellectual property rights or material breach of these Terms.
This section does not apply to Consumers to the extent that it would restrict mandatory consumer rights or impose liability not permitted by applicable law.
20. Suspension and Termination
We may suspend or terminate access to the Website or a Digital Product where we reasonably believe that you have materially breached these Terms, infringed intellectual property rights, engaged in fraud or created a security risk.
Where appropriate, we will provide notice and a reasonable opportunity to remedy the breach before termination. Immediate action may be taken where necessary to prevent fraud, unlawful activity, security harm or continued infringement.
Termination does not affect rights or obligations that arose before termination. Provisions concerning Contributions, supporter acknowledgements, intellectual property, liability, governing law and other terms intended by their nature to survive will remain in effect.
21. Changes to These Terms
We may update these Terms to reflect changes in our products, film project, business practices, technology or legal obligations.
The version applicable to an Order or Contribution is the version presented or linked when the relevant transaction is made. Material changes will not retroactively reduce mandatory rights relating to a completed transaction unless required by law or expressly agreed with you.
The latest version will be published on this page with the updated date shown above.
22. Governing Law and Dispute Resolution
These Terms and any dispute arising from them are governed by the laws of the Republic of Estonia, without prejudice to any mandatory consumer protection rights available under the law of your country of habitual residence.
We encourage you to contact us first so that we can attempt to resolve any concern directly.
If you are a Consumer residing in the European Union or European Economic Area, you may also have the right to submit a complaint to the competent consumer dispute resolution body in your country of residence. You retain the right to bring proceedings before any court that has jurisdiction under applicable law.
For business Users, disputes that cannot be resolved amicably will be subject to the courts of the Republic of Estonia, unless applicable law requires otherwise.
23. General Provisions
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be interpreted or replaced, where legally possible, in a way that most closely reflects its lawful purpose.
Our failure to enforce a provision does not constitute a waiver of that provision or any other right.
You may not assign or transfer your rights under these Terms without our prior written consent. We may transfer our rights and obligations as part of a business reorganisation or transfer, provided that this does not reduce mandatory rights available to Consumers.
These Terms, together with the relevant product or contribution description, Order or payment confirmation and Privacy Policy, form the agreement between you and us regarding the relevant transaction and use of the Website.
